ARTICLE 1: OBJECT 

These conditions govern the sale of ALMA SWIMWEAR items presented on the Site by the company MAISON MER SAS, with a capital of 3,000.00 Euros, registered with the RCS of Paris under the number 848 229 373, whose registered office is located at 11-15, rue Jean Bologne - 75016 Paris - France (hereinafter referred to as "ALMA SWIMWEAR") to all non-commercial and adult individuals only (hereinafter referred to as the "Customer").

ARTICLE 2. PRODUCTS 

2.1 CHARACTERISTICS OF THE PRODUCTS 

The products offered for sale online are those presented on the Site. They are described and reproduced by ALMA SWIMWEAR on the Site with the greatest possible accuracy. The information communicated on the product sheet mentions in particular the essential characteristics of the products (color, description, composition, maintenance, dimensions), their price including tax (all taxes included). However, ALMA SWIMWEAR draws the Customer's attention to the fact that the photographs cannot ensure perfect similarity with the product offered for sale, in particular with regard to colors. The differences can result from the color quality of the photographs, from the difficulty of making the rendering of the materials appear on the screen or even, without being exhaustive, the technical adaptation. These differences cannot be interpreted as defects in conformity and lead to the cancellation of the sale. In the event of a manifest error or insignificant omission between the characteristics of the product and its representation and / or description, ALMA SWIMWEAR cannot be held liable. The product offers and prices listed on the Site are valid as long as they appear on the Site, while stocks last.  

2.2 AVAILABILITY OF PRODUCTS 

The products are offered for sale while stocks last. Only the products appearing on the Site on the day of its consultation by the Customer are offered for sale. Thus, when placing an order, the Customer is informed of the availability of the selected Product. In case of unavailability of a product, ALMA SWIMWEAR undertakes to inform the Customer as soon as possible by email and to indicate to him, if necessary, the estimated waiting time to deliver the product.

The Customer may confirm his order or request a refund of the product on the basis of the price invoiced. 

The preparation and delivery costs will be reimbursed to the Customer if the latter confirms the cancellation of the entire order.

ARTICLE 3. PRICE 
ALMA SWIMWEAR allows the customer to have the prices displayed in its preferred currency such as  Euros (€), GBP (£), USD ($) or CAD. However, the final payment collection will be in Euros (the system will apply the exchange rate of the day). Prices are inclusive of taxes, including VAT (when applicable) and exclude preparation and delivery costs which vary according to the countries concerned.The prices indicated take into account the VAT applicable on the day of the order. If the VAT rate changes, it will automatically be reflected in the price of the items. Delivery cost is communicated to the Customer on the order’s summary, before its validation. Any order implies acceptance of the prices and description of the products available for sale. Any dispute on this point will occur as part of a possible "exchange / refund" as detailed below. At any time, ALMA SWIMWEAR reserves the right to modify the prices and descriptions of the products and in particular in the event of an increase in charges, in particular the rate of VAT, and / or in the event of a typographical error or obvious entry. However, the products will be invoiced on the basis of the prices in force at the time of the registration of the order, unless there is manifest error. Indeed, despite ALMA SWIMWEAR's vigilance, price errors may occur on the Site for whatever reason (computer bug, manual error, technical error ...). If orders have been placed at erroneous or clearly ridiculous prices (low price), orders will be canceled, even if they had been confirmed by ALMA SWIMWEAR services. ALMA SWIMWEAR will then inform each of its concerned Customers as soon as possible, so that they are able, if they wish, to reorder their order at the corrected and exact price. 

ARTICLE 4. ORDER

4.1 CUSTOMER NUMBER 

All Customers must complete the fields offered to them, to create their Customer profile and obtain their login credentials, these are personal. Any loss or forgetting of these identifiers must be reported to ALMA SWIMWEAR promptly by contacting Web Customer Service. To place an order, the Customer must complete a registration form and in particular complete the information necessary for his identification: Valid email address and password of his choice (confidential and personal) for the identification of the Client on the Site, personal data marked with an asterisk, required and necessary for processing invoices and delivering orders.It is important that the Customer completes the form as accurately as possible in order to avoid any error or impact in the shipment of the item (s) ordered. The data recorded on this Site is exclusively intended for ALMA SWIMWEAR or its partners in the event of express acceptance by the Customer under the conditions referred to below. 

4.2 REGISTRATION OF THE ORDER 

Any Customer who wishes to place an Order selects the Product (s) of their choice by clicking on "Add to cart". At the end of this step, and after clicking on "Checkout", a summary page corresponding to the Order form appears on the screen, allowing the Customer to make any changes and then confirm by clicking on "Complete Order”. 

4.3 VALIDATION OF THE ORDER 

The Purchasing Customer guarantees ALMA SWIMWEAR that it has the necessary authorizations to use the payment method that it has chosen for its order, when registering the order. The Customer by the validation of his shopping basket, the summary Order form and the acceptance of the General Conditions of Sale gives his consent to proceed to the stage of validation of the order by payment. The price due by the Customer is the amount indicated on the summary order form of which the Customer has read before confirming his order. This validation implies express acceptance of all operations carried out on the Site. All orders placed on the Site can be paid exclusively online using one of the following bank cards: Visa, Mastercard, American Express and all cards declined for these in the other countries concerned. The order is only taken into account after entering the bank card number, its expiration date and the cryptogram number (3-digit number on the back of the bank card and 4 digits in front of card for Amex) for payment. This payment is subject to final validation by the credit card company. In all cases, the online supply of the bank card number and the final validation of the order will be worth proof of the entire order in accordance with the provisions of the law of March 13, 2000 and will be worth due of the sums incurred by entering the items listed on the order form. This validation constitutes signature and express acceptance of all the operations carried out on the Site. However, in the event of fraudulent use of the bank card, the Customer is invited, as soon as this use is observed, to contact ALMA SWIMWEAR customer service service@almaswimwear.fr  

4.4 SECURE PAYMENT

 ALMA SWIMWEAR uses the HEIDELPAY secure payment service which integrates the SSL security standard. Confidential data (card number, expiration date) are transmitted encoded directly on the HEIDELPAY server and are never transmitted to our server. The HEIDELPAY server is itself directly connected to the servers of the banks in each country concerned.

4.5 ACKNOWLEDGMENT OF RECEIPT 

The final validation of the Order takes place after validation of the payment. An email confirming the Order and payment will be sent to the Customer, thus confirming their registration with a summary of all the information already communicated, the General Conditions of Sale and the withdrawal form. 

4.6 TRACKING OF ORDERS 

The details and monitoring of the delivery of each order can be viewed at any time on the Site, in "My Account" after the Customer has identified himself with his email and password. 

ARTICLE 5. DELIVERY 

Except in cases of force majeure or unforeseeable and insurmountable fact, the delivery times will be those indicated below and run from the date of confirmation of the order. They are communicated to the Customer before any validation of order and payment. It is therefore the Customer's responsibility to choose the country of delivery and its mode of delivery when it is offered to them. ALMA SWIMWEAR takes every precaution to ensure that its packages arrive in perfect condition. However, the Customer is required to check the condition of the packaging and the conformity of the product delivered, and to make any reservations on the delivery slip of the carrier, if necessary.

We process and prepare packages from Monday to Friday.

The preparation of your order is done in 24 h. The delivery times are those applied by our partners (Colissimo and DHL) and should not exceed 7 days from the date of shipping (except in cases of force majeure). Should the package being lost, the customer will be reimbursed for the amount of his/her order. 

ARTICLE 6. RIGHT OF WITHDRAWAL  

Even if our return policy is more favorable than that stated in the French law, we are under obligation to quote the corresponding article: Article L. 221-18 from French consumption act. In accordance with the French law, the Customer has a right of withdrawal for a period of 14 (fourteen) days from receipt of his order, which he can exercise without having to justify his decision or to support other costs than those necessary to return the order. To exercise this right, the Customer is required to return the withdrawal form attached to his order confirmation email, or accessible on the Site or any other declaration, unambiguous, expressing his desire to withdraw. The Products must not have been worn or washed and must be returned in their original packaging and label, accompanied by the printed invoice (the invoice is available on the Site, in the "My Account" section). Please note: Items returned incomplete, damaged, damaged or soiled by the customer will not be accepted. The withdrawal form can be returned by the Customer: by e-mail: service@almaswimwear.com 

ARTICLE 7. RETURNS AND REFUNDS 
with ALMA SWIMWEAR. You have the right to change your mind! From the date of your order, you have 30 days to return your item (unworn and unwashed in its original packaging).

We recommend wearing appropriate under garments when trying items on until you are certain that the fit and style are to your liking.

Please avoid putting makeup, deodorant, tanning cream, any bodily fluids or any other stains on the item. Items received back in such condition will not be accepted and either disposed of or returned to the client. No credit will be issued, and the purchaser will be charged for the cost of return postage and forfeit all claims.

ALMA SWIMWEAR offers free returns on all orders over EUR 50,00 from within FRANCE and ZONE 1 (Belgium, Germany, Italy, Luxembourg, Netherlands, Spain (Except Tenerife and Baleares), UK and Vatican City) with the exception of Final Sale and Clearance items which are not eligible for return. 

ONE free prepaid return label will be provided per order, a EUR 15,00 charge per label will apply to any subsequent returns on the same order. 

7.1 RETURN FOR REFUND

Returns for refund must be received back within 30 days of your delivery date. If your return is received outside of this time frame, our store credit policy will apply (see below).

Shipping fees are non-refundable. Orders that receive our free shipping promotion will be subject to a one-time EUR 15,00 fee should the entire order be returned, or the value of the returned merchandise brings the new order total to below $50.

Returns valued at $500 or more (total value of all merchandise being returned before any discounts, taxes or shipping fees) will be subject to a 15% restocking fee.

Refunds will be issued to the original form of payment.

Note: Orders from outside of FRANCE and ZONE 1 (Belgium, Italy, Luxembourg, Netherlands, Spain (Except Tenerife and Baleares), UK and Vatican City) are ONLY eligible for a store credit only minus a one-time EUR 15,00 return fee. 

7.2 RETURN FOR STORE CREDIT

Returns for store credit must be received back within 30 days of your delivery date. Any return received back after 30 days will be refused and returned to the sender. Shipping fees are not refundable and will be deducted from any credit amount. Store credits are issued in the form of an e-gift card and will be sent to the email address used to place the original order.

7.3 FINAL SALE & CLEARANCE ITEMS

Select items on our website may be marked as final sale, these items include clearance sale items, and special-order items. These final sale and clearance items are not eligible for returns.

7.4 RETURN CONDITIONS

Items must be returned to us in their original new condition, with all tags attached and sanitary liners in place.

We recommend wearing appropriate under garments when trying items on until you are certain that the fit and style are to your liking.

Items received back in such condition will not be accepted and either disposed of or returned to the client. 7.5 HOW TO MAKE A RETURN ?

To request a return service on our website, follow these steps:

1. Obtain a Return Authorization Number (RA)

b. Enter your email

c. Enter your order number

d. Select the items you wish to return.

e. Select the reason of the return.

f. Write an additional note (optional)

g. Upload images of the returned product (optional)

h. Select your return option (refund or store credit).

i. Select your delivery option for your return.

 After all this steps, you'll obtain a Return Request code (RA#) that  will appear on your screen and also in an email notification.

2. After revision of your return request you'll receive a second another with further instructions.

Remember that any item(s) returned without a RA# will be refused and returned at the sender's expense.

7.6 WHAT ITEMS ARE NON-REFUNDABLE?

  • Items purchased past the 30-days return policy. 
  • Items marked as final sale.
  • Free gifts or promotional items with retail value.
  • Items purchased using a 30% discount code or above.
  • Sales and clearance items.  
  • Original shipping and handling fees (when applicable)
  • International orders in Zones 2, 3, 4, 5 (USA and CANADA are ONLY eligible for a store credit only, minus a one-time EUR 15,00 return fee

7.7 WHAT SHOULD I DO IF MY ITEM IS DAMAGED?
ALMA SWIMWEAR guarantees its clothing to be free from damage or manufacturer defect for the first 30 days from date of order as long as you follow our care instructions. ALMA SWIMWEAR swimwear is delicate and experience normal "wear and tear" over time. 

If for any reason, you receive a damaged or defective item, please let us within 5 days of receiving your merchandise and we will happily exchange the unwashed / unworn item for the same item at no cost. Please note that items damaged as a result of normal wear and tear are not considered to be faulty and will be handled on a case by case basis. Hot tubs, swimming pools and suntan lotions may cause fading, yellowing or stains. These are not considered defects and, therefore, items may not be returned for any of these reasons.

7.8 WHEN WILL I GET MY REFUND?
Once your items are inspected by the return department, you'll get your refund notice typically within 48 hours. It may take up to 7-10 business days for the refund to be fully processed by the credit card company.

International orders in Zone 1, will be processed as French local order, International Zones 2, 3, 4, 5, are allowed to be returned but will only be eligible for a store credit. ARTICLE 8. CLAIM 
For any questions about an order, ALMA SWIMWEAR customer service is available to its customers via the "Contact Us" section. In the event of a dispute, all customers must provide their order number and the exact reason for their request. Following the resolution of a dispute and if it is necessary to make a refund, it is made directly on card used by the customer by the secure payment partner HEIDELPAY

ALMA SWIMWEAR informs its customers that by placing an order on the Site, the recorded customer data will be used by internal departments, those of our sister companies, and / or those of the companies in the group to which ALMA SWIMWEAR belongs: for order processing, in order to inform them of news and upcoming events by sending newsletters, and to offer him commercial offers and contests. ARTICLE 10 GUARANTEE 
The products offered comply with current French legislation. All Products benefit from the legal regime of the guarantee of conformity provided for in articles L211-4 and following of the Consumer Code, as well as the guarantee of hidden defects of articles 1641 and following of the Civil Code.   

ARTICLE 11. RESPONSIBILITY 
Despite the care taken with our site, the photographs and texts reproduced and illustrating the products presented, can sometimes contain errors. In the event of receipt of an article not in conformity with that viewed on the ALMA SWIMWEAR site, the customer may proceed to its exchange and / or refund in accordance with articles 7 and 8 of our general conditions of sale. ALMA SWIMWEAR cannot be held responsible for the non-performance of the contract concluded in the event of: out of stock or unavailability of the product, disruption, total or partial strike including postal services or means of transport and / or communications. These conditions apply for the duration of the posting of products and services offered for sale by ALMA SWIMWEAR. 


ARTICLE 14. PROOF 
The computerized registers kept in the information systems of ALMA SWIMWEAR and its partners under reasonable conditions of security, will be considered as proof of communication, orders and payments made between ALMA SWIMWEAR and the Customer. 

ARTICLE 15. APPLICABLE LAW – DISPUTES 
This agreement is subject to French law. The Original language of this contract is French. In the event of a dispute, the French courts will have sole jurisdiction. (Please also refer to Article 8 CLAIMS) 

ARTICLE 16. MODIFICATION OF THE GENERAL CONDITIONS OF SALE 
Given the possible changes to the Site, ALMA SWIMWEAR reserves the right to adapt or modify these general conditions of sale at any time. The new general conditions of sale will, if necessary, be brought to the attention of the customer by online modification and will be applicable only to sales made after the modification.   

ARTICLE 17. THE GIFT CARD 
The ALMA SWIMWEAR E-Gift Card, is only valid with www.almaswimwear.fr The Gift Card and its balance will expire 12 months after the date of purchase of the Card. It can be used once or several times within the limit of the available balance. When activated, the minimum amount credited to the ALMA SWIMWEAR Gift Card is set at € 15. The balance of the Gift Card can be viewed on www.almaswimwear.com. The Gift card is non-refundable and cannot be returned.  


GENERAL CONDITIONS OF USE OF E-GIFT CARD 
The e-Gift Card is a voucher that allows its holder to pay for his purchases, on the website www.almaswimwear.com. The holder of the e-Gift Card must be at least 18 years old or have the authorization of his parents to be able to use it. 

Its balance is available on www.almaswimwear.com 

It can be used in one or more installments, until the credit is used up and can be supplemented, if necessary, by any other means of payment. 

It is valid for a period of 12 months from the date of dispatch by email. It does not allow the purchase of another gift card. 

It cannot be re-credited or re-issued. In the event of theft, loss, data piracy, fraudulent use or expiration of the period of use, any amount still possibly available will be lost. No opposition can be made. It is not nominative. It cannot be compensated or reimbursed in cash.

In the event of a return to the store or warehouse, of a product purchased on the website by e-gift card, the buyer will receive a refund credited to his e-gift card This will be sent by e-mail to the address given on the ALMA SWIMWEAR order. 

The use of several e-gift cards to pay for the same purchase is not authorized on the website. 

The holder of the e-gift cards Card is responsible for its use.
